Cloud Act & Data Sovereignty

Why server location alone is not enough — and what this means for your data at Azure.

The US CLOUD Act obligates US companies like Microsoft to hand over data to US authorities upon request — regardless of server location. Even if your Azure VMs run in Frankfurt or Amsterdam, US authorities can demand access.

An expert opinion from the University of Cologne confirms: US surveillance laws (CLOUD Act, FISA Section 702) take precedence over all contractual data protection assurances from providers. Contractual promises such as "we will contest requests" have no legal binding force against US laws.

Particularly critical: The Trump administration dismissed three of five members of the Privacy and Civil Liberties Oversight Board (PCLOB) in early 2025. The body that monitors compliance with data protection commitments under the EU-US Data Privacy Framework is no longer quorate — the foundation of the adequacy decision is on shaky ground.

How do I compare Azure VMs with INGATE Cloud?
Azure offers virtual machines in fixed sizes (e.g. D8_v5 with 8 vCPUs and 32 GB RAM). With INGATE, you configure vCores and RAM individually — you only pay for what you actually need. Our price calculator above shows you the direct cost comparison for your desired configuration.
What are Azure egress costs and how much are they?
Azure charges up to 0.0737 EUR per gigabyte for outgoing data traffic (egress). With 10 TB of monthly traffic, that adds up to over 700 EUR in additional costs — per month. With INGATE Cloud Servers, all outgoing traffic is already included in the price — no volume limit and no additional fees.
Can I migrate from Azure to INGATE?
Yes. We support migration from Azure VMs to our KVM/Ceph-based cloud. Virtual hard disks (VHD/VHDX) are converted and imported. Our engineers personally guide the entire process — from planning through transfer to validation. A phased migration with parallel operation is also possible.
Is INGATE as reliable as Azure?
Yes. INGATE uses ISO 27001-certified data centers in Munich with redundant power supply, cooling, and network connectivity. Our HA Cloud provides automatic failover at the hypervisor level. Unlike Azure, you get dedicated hardware without noisy-neighbor effects and a personal point of contact.
Why is INGATE cheaper than Azure?
Three main reasons: First, INGATE eliminates egress costs entirely — often the largest cost component at Azure. Second, we use our own hardware in ISO-certified data centers without hyperscaler margins. Third, we rely on open-source technology (KVM/Ceph) without license costs. The result: Dedicated resources at a fraction of the Azure price.
Is INGATE subject to the US Cloud Act?
No. INGATE is a German GmbH. All data is stored and processed exclusively in Germany. The US Cloud Act, which allows US authorities to access data held by US companies — even when servers are located in Europe — does not apply to INGATE. This is particularly relevant for GDPR-sensitive industries and the public sector.
What hardware does INGATE use?
INGATE uses current AMD EPYC processors (Gen 4/5 — Genoa and Turin) with dedicated cores and no overcommitment. Storage is based on NVMe SSDs with triple replication (Ceph). Each server is guaranteed a PassMark score of at least 2,100 per core. Azure predominantly uses older generations (Gen 2/3) with shared resources.
How does support work at INGATE?
